Privacy Policy

Thank you for visiting www.yogalocal.com (the “Site“). Racewood Media, Inc., as the owner of the Site (”Racewood,” “We,” “Us” or “Our”), considers your right to online privacy of utmost importance. We recognize that when you choose to disclose information about yourself, you trust Racewood to act in a responsible manner. We have put this Privacy Policy in place to better explain how We use the Personally Identifiable Information and Non-Personally Identifiable Information (both as defined and described below under the “Information We Collect” heading) that you provide to Us during your use of the Site.

This Privacy Policy applies to all users who register an Account (as defined in Our Terms of Use Agreement, available at www.yogalocal.com (the “Terms of Use”)), and anonymous users as described in further detail below. Registered users and anonymous users are referred to in this Privacy Policy as “Users“, “You” or “Your.” This Privacy Policy covers all Personally Identifiable Information and Non-Personally Identifiable Information that is collected through Our Site. It does not, however, apply to persons or entities that we do not own or control, including, for example, Our Third Party Service Providers or Our Third Party Associates (each as defined below in this Privacy Policy), nor does it apply to Third Party Sites (as also defined below). By using or accessing the Site, You agree to Our privacy practices outlined in this Privacy Policy.

Please note that capitalized terms used but not defined in this Privacy Policy have the definitions set forth in the Terms of Use.

Information We Collect

We collect both Personally Identifiable Information and Non-Personally Identifiable Information. Personally Identifiable Information may be collected through and include the types of information described as Registration Information, Personal Site Use Information and Financial Information (each as defined below). We use both Personally Identifiable Information and Non-Personally Identifiable Information collected through the Site to learn more about how Our Users use the Site and to measure areas of interest. This allows Us to build features and functionality that will enhance Your experience and to identify, incorporate or integrate certain third party services or solutions that may enhance Your experience on the Site.

A. Non-Personally Identifiable Information

We keep track of the pages visited by each User. This information does not identify You personally. We refer to this type of information in this Privacy Policy as “Non-Personally Identifiable Information.” Our web server automatically collects some information about You when You request pages from Our server, including Your IP address. Your IP address is a number that is used by computers connected to the Internet to identify Your computer so that data (such as the web pages You request) can be sent to You. We aggregate this data with data on the pages visited by other Users to track overall User traffic patterns. We use this information to improve the Site by making it more responsive to the needs and preferences of Our Users.

Use of Cookies and Web Beacons

We use cookies and web beacons to collect Non-Personally Identifiable Information from the Site. A cookie is an entry in a text file or folder on Your hard drive. A web beacon is a file located on the Site that tracks Your viewing of pages within the Site. We use cookies and web beacons when You Register on the Site so that on subsequent visits to the Site We can remember Your specified area of interest and any other information You have saved. Cookies and web beacons make the Site easier to use and help Us customize advertising and Site features. Cookies and web beacons also enable Us to provide You with a better experience by allowing Us to understand what areas of the Site are of interest to Our Users. This Non-Personally Identifiable Information which is gathered in Our log files is not linked to any Personally Identifiable Information and is utilized only for aggregate statistics.

We can only read cookies from Our own Site. You may choose to disable cookies in Your browser. If You choose to disable cookies, You can still access many of the pages within the Site.

B. Personally Identifiable Information

The term “Personally Identifiable Information” as used throughout this Privacy Policy means any information containing personal identifiable traits of a particular User and that is of the type of information described in one or more of the following categories of personal information collected from Users of Our Site, as described in detail below: Registration Information, Personal Site Use Information and Financial Information.

Registration Information. In order to activate an Account on the Site, You are required to Register. During the Registration process, You will provide Personally Identifiable Information such as Your name, email address, mailing address and/or date of birth. We refer to this Personally Identifiable Information as “Registration Information” in this Privacy Policy. We may use one of Our Third Party Service Providers (as defined below in this section) to authenticate and validate Registration Information You provide to Us. In that case, Your Registration Information is merged with information provided by Our Third Party Service Providers for Our internal marketing purposes. The Registration Information You provide may be combined with marketing research from internal and external sources in order to determine shopping and informational preferences. We may use Our Third Party Service Providers to facilitate targeted communications intended to be geared to Your interests. In addition to Our Third Party Service Providers, We may share Your Registration Information with Our business partners, including Our Merchant Users, Deal Merchants and other Sellers with whom we partner, as well as Our subsidiaries, affiliates and direct and indirect shareholders, as described below under the heading “Sharing Personally Identifiable Information.”  These business partners (including such Merchant Users, Deal Merchants and Sellers), subsidiaries and affiliates are collectively referred to in this Privacy Policy as “Our Third Party Associates.” You may limit sharing of Your Registration Information with Our Third Party Associates by following the procedures set out in the “Right to Opt Out” section of this Privacy Policy. “Our Third Party Service Providers” shall mean and include all third-party service providers or vendors whom We utilize to provide services for Us (including, for example, information-technology service providers) that involve or are related to Non-Personally Identifiable Information and Personally Identifiable Information subject to this Privacy Policy. For purposes of clarification, such Third Party Service Providers shall receive and hold all such information on Our behalf, and not for such provider’s own use or benefit, under this Privacy Policy.

Personal Site Use Information. We may use software and other technology to gather Personally Identifiable Information about Services You request and the various pages that You visit within the Site in order to customize Your experience and to gather marketing information. We refer to this Personally Identifiable Information as “Personal Site Use Information,” which We may use together with Your Registration Information to better understand Your needs, to adjust the Site to Your personal preferences, to send to You via email or postal mail newsletters, new product announcements and announcements regarding Deals, Seller Products, Seller Product Information, new features of the Site or other information about Our Third Party Associates that We feel may be of value to You, and for other similar business purposes. In order for Us to deliver materials to You, We may need to provide Your name, email address and other reasonably required contact information to Our Third Party Service Providers who supply these delivery services to Us. We may also use Our Third Party Service Providers to authenticate and validate Personal Site Use Information You provide to Us. In that case, the provider will merge Your Personal Site Use Information with information provided by the provider for Our internal marketing purposes, or We may merge Your Personal Site Use Information with data that has been provided to Us by the provider. The Personal Site Use Information You provide may be combined with marketing research from internal and external sources in order to determine shopping and informational preferences. We may use Our Third Party Service Providers to compile data and to facilitate targeted communications. These communications may be sent to You via display Content on Our Site (such as Ads or Links to articles, coupons, Deals, Deal Receipts, Seller Products, Seller Product Information or other information) or via emails or ground mail sent to You by Us, Our Third Party Service Providers or Our Third Party Associates referencing Our Services or the products or services of Our Third Party Associates that Our research indicates may be geared to Your interests. In addition to Our Third Party Service Providers, We may also share Your Personal Site Use Information with Our Third Party Associates as described below under the heading “Sharing Personally Identifiable Information.” You may limit sharing of Your Personal Site Use Information with Our Third Party Associates by following the procedures set out in the “Right to Opt Out” section of this Privacy Policy.

Financial Information. Depending on the nature of the Site’s Services that You elect to utilize in connection with Your Account (e.g., those portions of the Site requiring You to transfer funds to Racewood), You may be required to provide Us with certain financial information, such as bank account, credit card, or such other payment-mechanism information as may be required by Us on the Site or in the Registration Terms. We refer to this type of sensitive Personally Identifiable Information as “Financial Information.” In order to verify Your identity or address or manage risk, We may also require You to provide certain other information, such as Your social security number, and We may also need to obtain information about You from third parties such as credit bureaus and identity verification services. All such information we collect will be considered Financial Information. As noted below, Financial Information will not be shared with any third party except to the extent otherwise provided under the heading “Sharing Personally Identifiable Information” below.

Protection of Personally Identifiable Information

We may upload, process, catalog, and merge various types of Personally Identifiable Information collected through the Site and store that Personally Identifiable Information in one or more databases located on secured servers behind Our firewall. By using this Site, You agree to the transfer, collection, processing, and use of Your Personally Identifiable Information by or through this Site and as provided in this Privacy Policy. Some of the Personally Identifiable Information You may enter on Our Web site (e.g., the Financial Information) may be transmitted securely via Secure Sockets Layer (SSL), 128 bit encryption services. Pages utilizing this technology will have URLs that start with HTTPS instead of HTTP. We are SSL certified after You login to the Site. We also have a managed firewall in front of the Site which protects data stored behind the firewall.

Sharing Personally Identifiable Information

As noted above, Your Registration Information and Personal Site Use Information (but not Your Financial Information, except as may be required by one or more Disclosure Justifications, as defined below in this section) may be shared with Our Third Party Service Providers and/or Our Third Party Associates (including, without limitation, in connection with Your purchase of Seller Products or Deals by or through Our Site). As a result of such sharing, Our Third Party Associates may provide You with written or electronic product or service offerings or information that may be of interest to You. In certain instances You will have an opportunity to limit Our sharing of Your Registration Information with Our Third Party Associates at the time the Registration Information is collected. You also may limit Our sharing of either Your Registration Information or Your Personal Site Use Information with Our Third Party Associates by following the instructions in the “Right to Opt Out” section of this Privacy Policy, subject to the exceptions in that section. You understand and agree that We cannot control the type or frequency of information sent to You by any third parties or the procedures for discontinuing information from third parties. We will not sell or rent any of Your Personally Identifiable Information to third parties for a profit; rather, We share Your Personally Identifiable Information with only Our Third Party Service Providers and Our Third Party Associates, and subject to the restrictions and limitations set forth in this Privacy Policy.

Notwithstanding the above paragraph, however, We may disclose Your Financial Information to credit bureaus to report account information.

As stated in the Terms of Use, when You upload, post or submit to the Site, or send for display on the Site, any Submitted Content, or when you send any Submitted Content to other Users on the Site, You are granting Racewood a cost free, royalty-free, perpetual, non-exclusive, unrestricted, worldwide license to use the Submitted Content without restriction, including, without limitation, the right to copy, store, reproduce, modify, adapt, display, translate, transmit, perform, publish, create derivative works from, and to sublicense these rights to third parties. The foregoing license shall include the right to exploit any property rights in such Submitted Content, including but not limited to rights under copyright, trademark, service mark or patent Laws under any relevant jurisdiction. Nothing contained in this Privacy Policy shall limit or otherwise affect these rights.

Please note that We reserve the right to disclose any information subject to this Privacy Policy as We reasonably believe is necessary to do any of the following (each a “Disclosure Justification”): (i) satisfy any applicable Law or legal process or governmental request, (ii) enforce the Terms of Use, including investigation of potential violations of the Terms of Use, (iii) detect, prevent, or otherwise address fraud, security or technical issues, or (iv) protect the rights, property or safety of Racewood, its Users and the public.

In addition, when You use the Site, You may choose to interact or otherwise form connections with Our Third Party Associates. By virtue of forming those interactions or connections, You may automatically provide Our Third Party Associates with Personally Identifiable Information. Our Third Party Associates are not subject to this Privacy Policy, and We do not control the use or uses to which Our Third Party Associates may put the information that You provide to them.

You may choose to visit web sites (”Third Party Sites“) owned or controlled by third parties (including Our Third Party Associates) through Links or Ads that are provided on the Site as a convenience to You. If You do so, please be aware that a Link or Ad to a Third Party Site does not imply that We endorse the content on or the business of the Third Party Site. You are responsible for determining the integrity and reliability of the information on the Third Party Site. In accordance with Our Terms of Use, We are not responsible for the content, accuracy, or opinions expressed on any Third Party Site or the contents of any Ad. We will not, and are under no obligation to, investigate, monitor or check the Third Party Sites for accuracy or completeness, or for any obscene, scandalous, inflammatory, pornographic, indecent, profane, defamatory or unlawful content or materials. If You decide to leave the Site and access a Third Party Site or purchase any products, goods, services, deals, offers or coupons on such Third Party Site, You do so at Your own risk. We are not responsible for the privacy policies applicable to Third Party Sites. Once You link to a Third Party Site, this Privacy Policy is no longer in effect.

Right to Opt Out

You may choose to opt out of Our sharing of Your Registration Information and Your Personal Site Use Information with Our Third Party Associates by doing any of the following:

Note that, despite the above opt-out policy and procedures, to the extent you utilize certain Services of the Site (e.g., the Deals portion of the Site), we may be required as a matter of Our contract with a Seller (including a Deal Merchant) or for any other reasonable purpose to provide to such Seller certain Personally Identifiable Information reasonably necessary to permit such Seller to process the transaction involving the Seller Product (e.g., your name, shipping address, telephone number, email address, or other reasonably required contact information, as well as the particular Seller Product purchased by You). Further, even to the extent You elect to opt out under this section, We still reserve the right to disclose any Personally Identifiable Information for any of the Disclosure Justifications outlined in the previous section of this Privacy Policy.

If You need assistance in updating any Personally Identifiable Information You have provided to Us, please contact Our Customer Support team at support@bodylocal.com To aid Our processing of Your request, please include Your contact information (name, address, email), the name of the Service to which You subscribe or to which You need the changes applied, and the details of the change (e.g., update email address, unsubscribe from a newsletter). Any and all updated Personally Identifiable Information that You provide to Our Customer Support will also be covered by this Privacy Policy.

Children’s Privacy

IF YOU ARE UNDER 18 YEARS OLD, PLEASE READ THIS MESSAGE WITH YOUR PARENTS BEFORE YOU VISIT OUR SITE. PLEASE ASK QUESTIONS ABOUT ANYTHING ON THIS SITE THAT YOU DO NOT UNDERSTAND. IF YOU ARE THE PARENT OF A MINOR WHO IS USING THIS SITE, PLEASE READ THIS MESSAGE IN ITS ENTIRETY AND NOTIFY US IF YOU HAVE QUESTIONS.

The Site complies with the Children’s Online Privacy Protection Act (”COPPA“), which prescribes rules and regulations with respect to the collection of personal information from children under the age of thirteen (“Underage Children” and each an “Underage Child”). Consistent with COPPA, We do not knowingly collect any Personally Identifiable Information from Underage Children, nor do we advertise or market Our Site or the Seller Products offered on Our Site to Underage Children. The Seller Products offered on Our Site are not the types of products, goods or services that would generally be considered to generate interest in Underage Children or that would generally be marketed to Underage Children. We have no reason to believe that this Site will be particularly attractive to Underage Children, or that Underage Children will attempt to Register as Registered Users on the Site and thereby provide Us with their Personally Identifiable Information.

In order to Register an Account on Our Site or use the Site’s other interactive features, the User will be required to check a box indicating that the User is 13 or older (and thus is not an Underage Child) (the “Age Representation Box”), and if such box is not checked, the User will not be permitted to Register as a Registered User or to use such interactive features on the Site (including, without limitation, our “Contact Us” page, which allows Users to send Us correspondence, or using features permitting Users to submit Submitted Content for inclusion on the Site). To the extent an Underage Child misrepresents that he or she is 13 or older by checking the Age Representation Box, and to the extent We discover such misrepresentation in the course of regular business operations, We will terminate such Underage Child’s Account or Registered User status, block further activities and use of the Site under such Account and status and purge from Our Site the Personally Identifiable Information associated with such Account or status.

Note that You must be age 18 or older to purchase any good, product or service (including any Seller Product) on Our Site. If You are under age 18 and wish to purchase any of the above items, You must ask Your parent or guardian to do so on Your behalf.

Please note that children (whether Underage Children or otherwise) may visit the many educational and informational pages on Our Site as a non-interactive observer without being required to disclose any Personally Identifiable Information. We also have pages where a User age 18 or older can purchase Deal Receipts, Seller Products or any other goods, services or products through the Site.

Your California Privacy Rights

If You are a California resident, You have the right to receive: a) information identifying any third party company(ies) to whom We may have disclosed, within the previous calendar year, Your Personally Identifiable Information for that company’s direct marketing purposes; and b) a description of the categories of Personally Identifiable Information disclosed.
